1. Acceptance of Terms

By accessing or using any services, media, or communications provided by Digitoral Media Productions LLC (“we,” “our,” or “Digitoral”), you agree to be bound by these Terms of Service. These terms apply to all users, clients, collaborators, and site visitors.

 

2. Services Provided

Digitoral Media Productions specializes in video production, post-production, podcast creation, and media content development. Our offerings include but are not limited to:

  • One-camera and multi-camera shoots

  • Audio capture and editing

  • Event and wedding videography

  • Post-production and color grading

  • Licensing and ownership transfer of raw and edited footage

 

3. Booking & Payment Terms

  • A 50% deposit is required to reserve a shoot date.

  • All deposits must be paid at least 72 hours prior to the shoot.

  • Final balance is due upon delivery of the final project unless otherwise agreed in writing.

 

4. Cancellation & Rescheduling Policy

  • Cancellations made 72+ hours in advance are eligible for a full refund of the deposit.

  • Cancellations made between 48–72 hours prior to the shoot will result in a 50% cancellation fee (50% of the deposit).

  • Cancellations made less than 48 hours prior to the shoot are non-refundable.

  • Rescheduling is allowed with at least 48 hours’ notice, and 100% of the deposit will be applied to the new date.

 

5. Footage Ownership & Licensing

A. Edited Content

  • Clients purchasing video services receive a license to use the final edited content for promotional or personal use.

  • Copyright remains with Digitoral unless a written transfer is executed.

B. Raw Footage

  • Raw footage is not included by default in service packages.

  • A separate Raw Footage License or Ownership Transfer Agreement must be executed for access to or ownership of raw materials.

  • Ownership transfer of raw footage may incur additional fees and is governed by a stand-alone agreement.

 

6. Usage Rights

Unless otherwise agreed in writing:

  • Digitoral reserves the right to use any footage or edited work for portfolio, promotional, or internal purposes.

  • Clients may not resell, re-edit, or redistribute our content commercially without proper licensing.

 

7. Credit & Attribution

We appreciate, though do not require, client credit for edited content as follows:
“Video by Digitoral Media Productions”.

 

8. Venue & Subject Releases

  • Clients are responsible for obtaining consent or releases from event participants unless otherwise agreed.

  • If filming in public or private venues, a Venue Release Agreement must be signed by the property owner or event organizer. Digitoral will also post signage indicating that recording is taking place.

 

9. Limitation of Liability

Digitoral Media Productions is not liable for:

  • Loss or damage of footage due to technical failure, theft, or acts of nature.

  • Any indirect, incidental, or consequential damages arising from your use of our services or media.

 

10. Indemnification

Clients agree to indemnify and hold Digitoral Media Productions harmless from any claims, damages, or legal expenses arising from the use or distribution of footage, particularly raw footage transferred under a licensing or ownership agreement.

 

11. Governing Law

These Terms are governed by the laws of the State of New York, without regard to conflict of law principles. Any disputes shall be resolved in the appropriate courts of New York City, NY.

 

12. Modifications to Terms

Digitoral reserves the right to update these Terms of Service at any time. Changes will be posted on this page with an updated effective date. Your continued use of our services constitutes acceptance of any revised terms.
